This agenda has been prepared to provide for the orderly progression of City business. Detailed staff reports on specific items are posted in the hallway for public viewing. The City Council wants to hear your comments, however, to run the meeting efficiently, please observe the following rules when you participate in the meeting:

 

Please try to submit your REQUEST TO ADDRESS THE CITY COUNCIL form to the City Clerk prior to the start of the meeting. You will be called at the appropriate time to make your remarks. The City Clerk cannot accept any request submitted after the start of the second speaker's comment on any item.

 

Regardless of the number of items you wish to address, you will be limited to ten minutes for the entire meeting. If you participate in a noticed public hearing, however, the time you take to make your comments will not be counted against the ten minute limitation.

For the sake of efficiency, the City Council agenda is divided into several sections: Consent Calendar: This section consists of routine items which, unless a request has been received from the public, council or staff to remove a particular item for discussion, are enacted by one motion of the City Council. If you wish to speak to any Consent Calendar item(s) you will be limited to five minutes. Public Hearings: This section is devoted to noticed hearings; the length of time you get to speak during these hearings is frequently determined by the number of speakers on the item. Generally, you will be allowed three minutes unless the Mayor announces otherwise. Regular Business: This section contains items of general business and you will be allowed three minutes to speak on any item.

Audience Comments: This part of the agenda is limited to 15 minutes and is reserved for making comments on matters which are NOT on the agenda. If you have submitted a request to speak, you will be called by the City Clerk at the appropriate time and you may speak for up to three minutes. Please limit your comments to matters within the jurisdiction of the City Council. Due to State law, no action can be taken on matters brought up under Audience Comments. If action by the City Council is necessary, the matter may be placed on a future agenda or referred to staff, as determined by Council.

 

Please make your remarks at the lectern microphone and direct your comments to the City Council and not to the staff or the public.

Conduct At the Council Meeting: The City Council has adopted a set of rules for conduct during City Council meetings. The following is an excerpt from those adopted Rules of Procedure:

 

Section 6.3 The Mayor shall order removed from the Council Chambers any person(s) who commit the following acts at a regular or special meeting of the City Council:

 

1. Disorderly, contemptuous or insolent behavior toward the Council or any member thereof, tending to interrupt the due and orderly course of said meeting.

 

2. A breach of the peace, boisterous conduct or violent disturbance, tending to interrupt the due and orderly course of said meeting.

 

3. Disobedience of any lawful order of the Mayor which shall include an order to be seated or to refrain from addressing the Council.

2. Minutes of March 17 View Restoration Appeal Hearing and March 17, 1998 Regular City Council meeting. (Purcell)

Recommendation: Approve the minutes.

 

3. Claim Against the City by Wei Chen Tung. (Purcell)

Recommendation: Reject the claim and direct the City Clerk to notify the claimant.

 

4. Commercial refuse and collection agreement with Easy Roll Off services. (Ramezani)

Recommendation: Authorize the Mayor and the City Clerk to execute a Nonexclusive Franchise Agreement for Commercial Refuse Collection and Disposal Services with Easy Roll Off Services to be effective through December 31, 1998.

 

5. Time Extension for Vesting Tentative Tract Map Nos. 50666 and 50667 and compliance with conditions of approval for the vacation of a portion of Paseo del Mar right-of-way for the Ocean Trails Project. (Petru)

Recommendation: 1. Extend the approvals for Vesting Tentative Tract Map Nos. 50666 and 50667 and related applications for the Ocean Trails project for one (1) year, until April 15, 1999. 2. Adopt RESOLUTION NO. 98- ; AMENDING RESOLUTION NO. 96-97 AND REPEALING RESOLUTION NO. 97-83 REGARDING THE VACATION OF A PORTION OF PASEO DEL MAR, TO ALLOW AN ADDITIONAL SIX MONTHS FOR THE APPLICANT TO COMPLETE THE NECESSARY ITEMS OF WORK.

 

6. Establishment of Speed Limits. (Allison)

Recommendation: ADOPT RESOLUTION NO. 98-___, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES ESTABLISHING SPEED LIMITS ON VARIOUS STREETS.

 

7. Request for Approval to develop a drainage reimbursement agreement. (McBride)

Recommendation: Authorize staff to develop a drainage reimbursement agreement with Donald Glass, the property owner at 11 Marguerite (assessors parcel number 7582-001-025), associated with the drainage system improvement on Palos Verdes Drive West at the north City limit.

 

8. Supplemental Agreement for Scenic Turnouts. (Ramezani)

Recommendation: ADOPT RESOLUTION NO. 98-___ AUTHORIZING THE MAYOR AND THE CITY CLERK TO SIGN THE PROGRAM SUPPLEMENT FUNDING AGREEMENT WITH THE STATE OF CALIFORNIA FOR THE PRELIMINARY ENGINEERING PORTION OF THE PROJECT TO CONSTRUCT TWO SCENIC TURNOUTS ALONG PALOS VERDES DRIVE WEST AND SOUTH, A FEDERAL-AID PROJECT.

 

9. ORDINANCE NO. 333 - Amendments to the Burglar Alarm Ordinance, Chapter 9.04 of the Municipal Code. (McLean)

Recommendation: ADOPT ORDINANCE NO. 333 OF THE CITY OF RANCHO PALOS VERDES AMENDING THE BURGLAR ALARM ORDINANCE FOUND IN CHAPTER 9.04 OF THE MUNICIPAL CODE OF THE CITY OF RANCHO PALOS VERDES. (This Ordinance was introduced at the March 17, 1998 meeting).

 

10. ORDINANCE NO. 334 - Amendments to the Budget Administration, Chapter 3.32 of the Municipal Code. (McLean)

Recommendation: ADOPT ORDINANCE NO. 334 OF THE CITY OF RANCHO PALOS VERDES AMENDING THE BUDGET ADMINISTRATION FOUND IN CHAPTER 3.32 OF THE MUNICIPAL CODE OF THE CITY OF RANCHO PALOS VERDES. (This Ordinance was introduced at the March 17, 1998 meeting.)

 

11. View Restoration Permit No. 29; Applicant: Mr. Norbert Keilbach, 3632 Greve Drive; foliage Owner: Mr. Jon Echeveretta, 30327 Ganado Drive. (Nelson)

Recommendation: ADOPT RESOLUTION NO. 98- , A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES AFFIRMING THE APPROVAL OF VIEW RESTORATION PERMIT NO. 29 TO TOP, TRIM, AND/OR REMOVE TREES AT 30327 GANADO DRIVE.

 

12. Park Site Weed Abatement. (Evans)

Recommendation: (1) Authorize staff to proceed with the selective removal of invasive grasses and non-native trees and the application of herbicide at a City park site. (2) Adopt Resolution 98- AMENDING RESOLUTION 97-55, THE BUDGET APPROPRIATION FOR FISCAL YEAR 97-98, FOR A BUDGET ADJUSTMENT TO THE CITY'S CAPITAL IMPROVEMENT PROJECT FUND AND QUIMBY FUND.

 

13. Register of Demands. (McLean)

Recommendation: ADOPT RESOL. NO. 98- , A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES ALLOWING CERTAIN CLAIMS AND DEMANDS AND SPECIFYING FUNDS FROM WHICH THE SAME ARE TO BE PAID.

14. Proposed ordinance amending the City's health Code, Chapter 8.04. (Park)

Recommendation: Remove this item from the agenda and direct staff to re-advertise for a public hearing after the County has decided upon the final revisions to the County's Health and Safety Code.

 

REGULAR BUSINESS:

 

15. Cancellation of Contract with Satsuma Landscape & Maintenance for Median Landscape and award the contract for median landscaping to Bennett Enterprises. (Hillstead)

Recommendation: 1. Terminate the contract with Satsuma Landscape & Maintenance for median landscaping. 2. Award a contract for median landscaping to Bennett Enterprises for $4,242.50 per month. 3. Authorize the Mayor and City Clerk to execute the contract documents on behalf of the City Council.

 

16. Citywide Landscaping and Lighting District. (Allison)

Recommendation: 1. ADOPT RESOLUTION NO. 98-____, INITIATING PROCEEDINGS FOR THE LEVY AND COLLECTION OF ASSESSMENTS WITHIN THE CITYWIDE LANDSCAPING AND LIGHTING MAINTENANCE DISTRICT FOR FISCAL YEAR 1998-99 AND ORDERING THE ENGINEER TO PREPARE A REPORT IN CONNECTION THEREWITH. 2. ADOPT RESOLUTION NO. 98-____, APPROVING THE ENGINEER'S REPORT IN CONNECTION WITH THE LEVY AND COLLECTION OF ASSESSMENTS WITHIN THE CITYWIDE LANDSCAPING AND LIGHTING MAINTENANCE DISTRICT FOR FISCAL YEAR 1998-99. 3. ADOPT RESOLUTION NO. 98-____, DECLARING THE CITY COUNCIL'S INTENTION TO LEVY AND COLLECT ASSESSMENTS WITHIN THE CITYWIDE LANDSCAPING AND LIGHTING MAINTENANCE DISTRICT FOR FISCAL YEAR 1998-99 AND SETTING A TIME AND PLACE FOR HEARING OBJECTIONS THERETO.

 

17. Animal Control Services Options. (Park)

Recommendation: 1. Direct staff to negotiate with Los Angeles County for a one-year "basic service" contract for shelter service, dog licensing administration/canvassing service and animal control field service. 2. Direct staff to report back to City Council after six months from the contract effective date to evaluate the County's animal control service. At that time, City Council may consider available alternatives for service, if warranted. 3. Direct staff to bring forward a new dog licensing fee structure at a future Council meeting.

 

18. Approval of City participation in construction of joint drainage facilities for Point Vicente Interpretive Center and Tract 46628 - Subregion 1. (Evans)

Recommendation: Approve the expenditure of up to $200,000 to participate in the construction of an over-sized drainage facility constructed by CPH Building in Tract 46628 (Subregion 1); and authorize the City Attorney to prepare the necessary agreement.

 

19. Petition by The Golden Lotus Restaurant to the Department of Alcoholic Beverage Control (ABC) to modify the restaurant's current ABC license. (Rojas)

RECOMMENDATION: Provide Staff with direction on the content of the City's formal response to the petition.

 

20. Natural Community Conservation Planning (NCCP) Project. (Rojas)

Recommendation: Award a contract to Ogden Environmental and authorize the Mayor and the City Clerk to execute a professional services agreement with Ogden for the completion of Phase II of the City's NCCP.

 

21. Job Sharing of Existing Full-Time Positions. (Petru)

Recommendation: 1. INTRODUCE ORDINANCE NO. ; AMENDING TITLE 2 (PERSONNEL SYSTEM) OF THE RANCHO PALOS VERDES MUNICIPAL CODE TO INCLUDE SHARED FULL-TIME POSITIONS. 2. Review the draft resolution amending Resolution No. 94-56 by adopting revisions to the Competitive Service Employee Personnel Rules to provide the ability for job sharing of existing full-time positions.

 

22. Request to Reschedule the May 5, 1998 City Council Meeting and Budget Work Session. (Petru)

Recommendation: Consider rescheduling or cancelling the regular City Council meeting and Budget Work Session currently scheduled for May 5, 1998.

 

23. Modification of Municipal Code relating to the number of Ham Radio or Commercial Antennas Allowed on a single parcel. (Bussey)

Recommendation: 1. If the Council wishes to have a review of the number of commercial and/or ham radio antennas allowed on a single parcel, adopt URGENCY ORDINANCE NO. ____ AN ORDINANCE OF THE CITY OF RANCHO PALOS VERDES DECLARING AND IMPOSING A MORATORIUM ON THE ACCEPTANCE OR PROCESSING OF APPLICATIONS AND THE ISSUANCE OF PERMITS OR OTHER ENTITLEMENTS FOR THE CONSTRUCTION OF MORE THAN ONE COMMERCIAL ANTENNA OR HAM RADIO ANTENNA ON ANY LOT WITHIN THE CITY, AND DECLARING THE URGENCY THEREOF. 2. If the Moratorium Ordinance is adopted, instruct the staff to prepare a draft amendment to the Municipal Code limiting the number of ham radio antennas allowed per lot and schedule the matter for hearing before the Planning Commission.
